2. Proclamation No.2 appointed Mr. Gimson Lieutenant

Governor, and empowered him to set up and administer the civil

government in the Colony, together with a Executive and a

Legislative Council. The proclamation also vested in the

Supreme Court of the Colony and in the Court of the Magistrate

Victoria, their former jurisdiction with the exception of

certain offences which were to be dealt with by e Military

Court.

3. Proclamation No.2 was quite contrary to the direc-

tives and proclamations agreed in London and was, in point of

fact, impracticable because of the necessity of repatriating

Mr. Gimson and other prominent officials and to the

impossibility of giving practical effect to the jurisdiction
